Mediation Requires Preparation

Mediation is no different than trial when it comes to success. You may be helped (or hurt) by plain luck, but the best way to win at trial or to obtain a good result at mediation is through careful preparation. Planning and then executing the plan is important for success.

Compromise or Different Viewpoints?

A commonly heard aphorism is that if both sides walk away unhappy, then the mediation was a success.

Does this dictate compromise? Or does it just highlight the importance of examining different viewpoints and recognizing risks?
