the following areas: Plaintiff's Employment Law The firm is primarily a practice that represents employees, whether the representation means helping employees prosecute matters against their employers (present or former) or defending actions by employers against them. When we prosecute actions against employers, it is most often for sexual or racial harassment, discrimination in promotion and termination, and wrongful discharge against public policy. We also handle at-will employment issues and problems with covenants not to compete. The firm frequently represents people who suffer retaliation on the job. Sometimes the firm represents people who may be better described as independent contractors rather than employees. This issue can be the subject of litigation itself.Executive Severance Executives come to the firm for help negotiating their severance
and departure from their jobs. Mr. Weaver is experienced in helping executives
evaluate what has happened to cause them to be leaving their employment.
In some cases, the evaluation suggests the need to file law suits to obtain
proper remedies for what has occurred. In other cases, the evaluation
suggests that negotiation is the preferred strategy, perhaps because of
an ongoing job search of the client or for other reasons. Personal Injury In addition to employment law, the firm represents individuals
who have suffered serious personal injuries, whether from auto accidents,
medical malpractice, or accidents or other incidents on the job. False Claims Act Cases A number of individuals who have felt that they suffered
retaliation on the job have experienced such harassment as a result of
their having reported improper and illegal activities of their employer.
Sometimes these individuals are found to have False Claims Act cases.
These claims are suits brought on behalf of the United States when the
employer has been submitting false claims for payment to the government.
The conduct in such cases violates the federal law, 29 U.S.C. 3729,
et seq., and Mr. Weaver is experienced in evaluating and handling
such cases. General Civil Litigation The firm sometimes handles other matters. If we cannot

Mediation Mr. Weaver is a frequent mediator of disputes and has mediated hundreds of cases in North Carolina during the past fifteen years as a certified Mediator in the state and federal courts. Mr. Weaver serves also as an Arbitrator for the American Arbitration Association and the National Arbitration Forum. In addition to his service as a neutral, Mr. Weaver is an Administrative Law Judge and Hearing Examiner for the North Carolina Department of Labor's Occupational Safety and Health Review Commission (OSHA).
